Terms

The terms for using Quillsmith and for a subscription.

This version applies to contracts concluded in English. The versions in the other languages are the same in substance; where they diverge, the version in the language in which you concluded the contract applies.

1. Parties and scope

Quillsmith is provided by Moltera Software OÜ, Tartu mnt 67/1-13b, 10115 Tallinn, Estonia (“Quillsmith”, “we”). These terms govern the use of Quillsmith and every subscription concluded through it.

These terms address consumers (Section 13 BGB). There is no offer for businesses at present; we may refuse orders from businesses.

2. What is yours

What you bring and write stays yours. We claim no ownership of what Quillsmith writes at your instruction; to the extent we hold any right in it, we assign it to you on creation. Whether such text is protected by copyright is decided by the law of your country; we do not warrant that it is protected or unique. You grant us the right we need to store your world, show it back to you and send the part a request needs to the model that answers it. Nothing more.

3. Account

One account is one person. Keep your password and your access tokens to yourself — a token acts as you, and anything holding it can read and change your worlds. You can see every signed-in device and revoke any of them from your settings.

Registration is open from the age of 18.

4. What is not allowed

Anything unlawful, anything that infringes someone else’s work, and anything whose purpose is to harm a real person. Fiction is fiction; this is about what the account is used for, not about what your characters do.

5. Plans and conclusion of the contract

Quillsmith offers subscriptions with a monthly or a yearly term. Every plan includes a monthly allowance of credits for the AI work Quillsmith does for your book: writing, planning, drawing the world out of the manuscript, and the checks. On a yearly term the allowance renews every month; what is left of a month’s allowance does not carry over. In any seven consecutive days you can use up to the share of the allowance stated on the pricing page. The plans differ in what Quillsmith does for your book and in the size of the allowance: Companion keeps your book together and writes none of its prose; on Companion, chat and generated prose require your own Claude or ChatGPT subscription connected to Quillsmith, while editing, reading and your own writing do not. Writer and Studio also write with you. Each plan’s features and allowance are stated on the pricing page; your usage page shows what you have used and when it renews. By invitation we may grant free access for a limited time; it ends without charge and does not turn into a subscription.

All prices include the statutory VAT. Payment is processed by our payment provider Stripe.

The subscription contract is concluded when you click “Order with obligation to pay” in the checkout and we confirm the payment. Immediately before the click you see the plan, the price, the term and the renewal. You receive the content of the contract and the withdrawal instruction by email.

6. Term, renewal, cancellation

A subscription runs for the chosen period (a month or a year) and renews for the same period unless cancelled before it ends.

You can cancel at any time to the end of the current period — in the customer portal or through the button “Verträge hier kündigen” (cancel contracts here) on every page. The cancellation takes effect at the end of the period; until then you keep using Quillsmith. A cancellation does not refund the current period.

We confirm the receipt and the time of the cancellation without undue delay by email (Section 312k(4) BGB).

7. Changing plans

A change to a higher plan takes effect at once; the difference is charged proportionately for the rest of the current period. A change to a lower plan takes effect at the end of the current period.

8. Right of withdrawal

As a consumer you have the right to withdraw from a subscription contract within fourteen days without giving any reason. The details, the consequences and the model withdrawal form are in the withdrawal instruction at /withdrawal; it is part of these terms.

At checkout you expressly request that we begin the service before the withdrawal period ends, and you confirm that you know this. If you withdraw after that, you pay for the service provided until the withdrawal an amount corresponding to its share of the full service of the billing period (Section 357a(2) BGB). That share is the greater of two values: the share of days elapsed in the billing period, and the share you have used of the billing period’s allowance of credits, which on a yearly term is twelve monthly allowances. This applies to every plan, Companion included, whose allowance carries the work Quillsmith does around your chapters.

You may also declare the withdrawal through the button “Verträge hier widerrufen” (withdraw from contracts here) on every page. We confirm the receipt with its date and time by email (Section 356a BGB).

9. What a withdrawal refunds

On a withdrawal we refund every payment we received for the subscription, less the amount under section 8, without undue delay and at the latest within fourteen days of receiving your withdrawal, to the means of payment you used.

10. Price changes

The price of your subscription does not change during the current period. If we want to change the price for the time after it, we tell you the new price by email at least 30 days before the next renewal and ask for your consent. If you do not consent, the subscription ends with the current period; it does not renew at the new price.

11. Usage limits

Each plan has limits on what the AI assistant does for you, shown on your usage page and counted as you go. A request past a limit is refused with the reason, never billed silently. A plan’s limits can change; a change that leaves you worse off is announced before it applies.

12. Export, deletion, availability

Export your manuscript whenever you like, and delete your account whenever you like. Deletion is permanent and takes the worlds with it, so export first.

Quillsmith is provided over the internet. We announce maintenance windows in advance; outages outside our control cannot be ruled out. Your statutory rights for defects in digital products (Sections 327 ff. BGB) remain unaffected. If Quillsmith is stopped or materially changed, you will be told in time to export your manuscript.

13. Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee. For ordinary negligence we are liable only for the breach of essential contractual duties, meaning duties whose fulfilment makes the proper performance of the contract possible at all and on whose observance you may regularly rely; in that case liability is limited to the foreseeable damage typical of the contract. Beyond that, liability is excluded.

14. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If your habitual residence is in another country, the mandatory consumer protections of that country remain unaffected.

15. Dispute resolution and contact

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
